    Update Napa man charged after firing gun outside short-term rental

    Francisco GutierrezDeAlba, 41, Napa, described as ‘angry, drunk, and high’ during incident

    – The Paso Robles Police Department has released additional details of the arrest made Tuesday:

    On Tuesday, Oct. 29, at about 8:33 a.m., our dispatch center started receiving calls of shots heard in the 500 block of 5th Street. Just prior to officers arriving on the scene, a reporting party stated the suspect drove off in a black SUV.

    Officers checked on a house in the 500 Block of 5th Street and found several spent 9mm shell casings out front.

    A responding officer found the black SUV a block away and noticed someone was trying to hide in the backseat. In the backseat, officers located Francisco GutierrezDeAlba (41, Napa).

    GutierrezDeAlba was in possession of an unserialized handgun (ghost gun). He was also under the influence of a controlled substance and very drunk.

    As the investigation unfolded, we learned that a female victim was fleeing from GuitierrezDeAlba and drove to Paso Robles to escape. GutierrezDeAlba likely tracked the victim to a short-term rental in the 500 block of 5th Street.

    Luckily, the victim fled again before GutierrezDeAlba arrived in town.

    Around 8:30 a.m., GutierrezDeAlba showed up to the short-term rental, beating on the door, demanding entry. Angry, drunk, and high, GutierrezDeAlba then fired at least six rounds from a pistol while outside the home. Fortunately, nobody was hit. GutierrezDeAlba then drove off.

    GutierrezDeAlba was arrested on numerous charges:

    • 646.9(a) PC – Stalking
    • 11550(e) H&S – Possession of a firearm while under the influence of a controlled substance
    • 246.3(a) PC – Negligent discharge of a firearm
    • 23152(g) VC – DUI

    GutierrezDeAlba was transported to the San Luis Obispo Sheriff’s Department where he was booked on the above listed charges. Bail was set at $1,000,000.

    No injuries reported

    – A man was taken into custody Tuesday morning after police responded to reports of gunfire on Oak Street, according to the Paso Robles Police Department.

    At approximately 8:33 a.m., a witness called police to report a man yelling in the 500 block of Oak Street. As officers headed to the scene, the witness reported hearing multiple gunshots in the area. Officers arriving on scene also heard gunfire as they approached Oak Street.

    Upon arrival, officers spoke with the witness, who said a man had left the area in a black SUV before police arrived. During a search of the area, officers saw a man entering the back seat of a black SUV parked one block north of the initial location. Officers approached the vehicle and identified the man as Francisco Gutierrez, 41, who was found hiding in the back seat.

    Police recovered a loaded firearm and spent shell casings from inside the SUV. Gutierrez was detained without further incident, and no injuries were reported.

    Officers also spoke with a female acquaintance of Gutierrez, who may have been involved in a verbal argument with him around the time of the gunfire. It is not yet clear if she was present when the incident occurred.

    Gutierrez has been taken into custody and is charged with negligent discharge of a firearm under PC 246.3.

    The investigation is ongoing. Police are asking anyone with additional information to contact Paso Robles Police Department Det. Place at (805) 227-7429.
