ICE detains Paso Robles man after SLO court hearing

Officials release criminal history to provide context to media reports
– A Paso Robles man reportedly detained by federal immigration authorities after a court appearance on July 2 has a prior criminal history in San Luis Obispo County, according to information released to local media Thursday from San Luis Obispo County District Attorney Dan Dow.
The man, identified as Ismael GarciaCruz, born April 26, 1994, in Mexico and a resident of Paso Robles, was allegedly taken into custody by immigration officials following a misdemeanor court hearing in San Luis Obispo County Superior Court.
Media reports, including one from The Tribune, stated that GarciaCruz was “plucked off the streets of SLO by immigration agents” as he walked to his car after court. Officials said those reports did not provide full context regarding his criminal record.
“I have no official information about what prompted the apparent arrest or detention by federal immigration officials,” the statement said. “However, we are releasing the following factual information about the individual’s San Luis Obispo County criminal justice history.”
GarciaCruz was first arrested on Oct. 2, 2024, by the Paso Robles Police Department for alleged domestic assault and battery against an intimate partner. Misdemeanor domestic violence charges were filed in San Luis Obispo County Superior Court. He later entered a plea to domestic violence battery under Penal Code section 243(e)(1). On Nov. 14, 2024, the court sentenced him to 20 days in county jail and placed him on three years of formal probation.
GarciaCruz was arrested again on Nov. 30, 2024, while on probation, by the Paso Robles Police Department. He was arrested for robbery (Penal Code section 211) and for violating a domestic violence restraining order (Penal Code section 273.6). The investigation led to the filing of a felony charge of criminal threats (Penal Code section 422) and a charge for violation of a criminal protective order (Penal Code section 166(c)(1)).
After a preliminary hearing, GarciaCruz was held to answer on felony charges. He later pled guilty under a plea agreement with the District Attorney, and the felony criminal threats charge was reduced to a misdemeanor. He was sentenced to 108 days in county jail and was placed on formal domestic violence probation for three years, beginning July 2.
